Research contracts and agreements

The Research Governance team also provides advice to the Network Director of Research and Chief Executive on all network/site research related agreements including:

Clinical Trial Research Agreements (CTRA), indemnity agreements, research grant and funding agreements, Clinical Trial Notifications (CTN),  Service Level Agreements (SLAs), Data Transfer Agreements (DTA) and Material Transfer Agreements (MTA) for:

  • compatibility with Ministry of Health requirements
  • risk exposure
  • correct identification of entities to the agreement
  • ensuring the document is executed as per approved SCHN delegations

Research Governance provides a Contracts Toolkit for Investigators to assist in determining the most appropriate agreement to use for the project. Please contact SCHN-Governance@health.nsw.gov.au for access to it.

Please note it is a requirement that you discuss any contracts with Research Governance PRIOR to submission of your SSA. If you have not discussed prior to submission your application will be rejected.

Please complete the contracts instruction sheet and submit to the governance office for review. You DO NOT need to complete the contracts instruction sheet if your agreement is submitted with your SSA.

The contracts instruction sheet also provides information on how to correctly identify SCHN in formal agreements.

SCHN is registered with the USA Office for Human Research Protection (OHRP) in two ways:

  • As an organisation with an accredited and recognised Institutional Review Board (IRB) i.e. HREC and
  • As a signatory to the Federalwide Assurance (FWA) for the Protection of Human Subjects

You will need these details if your project:

  • Is an international multi-site project
  • Originated in the US
  • Is supported or funded by a US-based agency or organisation

Confidential disclosure agreements (CDA)

Confidential Disclosure Agreements (CDA) relating to activities or projects being undertaken by SCHN researchers and that may involve the disclosure of confidential information by one or both parties must be signed by the SCHN Associate Director, Research Operations (ADRO) or the Director of Research (DoR).

Requests for execution of CDAs should be submitted to the Associate Director, Research Operations via email to cate.smith1@health.nsw.gov.au , accompanied by the SCHN CDA coversheet.

An SCHN CDA template is also available for use in the event that the other party does not provide one to you. Please contact Cate Smith or Nicole Suares  for assistance with a SCHN template CDA.

Data Transfer Agreements (DTA)

SCHN has its own DTA template for use in instances when SCHN is the party transferring data to another party (another institution).

A DTA is most appropriate to use in the situation in which SCHN is not expecting anything in return for the transfer of data.

Material Transfer Agreements (MTA) 

SCHN has its own MTA template for use in instances when SCHN is the party transferring materials (e.g. samples, tissue, blood, DNA) to another party (another institution).

A MTA is most appropriate to use in the situation in which SCHN is not expecting anything in return for the transfer of materials.

Service Level Agreements (SLAs) 

SCHN has its own Service Level Agreement template for use in instances when SCHN is the party providing services to another party (another institution) or when SCHN is the party receiving services from another party (another institution).

A Service Agreement is most appropriate to use in the situation in which payment is involved for the conduct of services.
